New York is one of a growing number of states nationally that now require employers to provide disability benefits coverage to employees for an off-the-job injury or illness and/or paid family leave coverage for employees and their families

The Disability and Paid Family Leave Benefits Law (Article 9 of the WCL) provides weekly cash benefits to replace, in part, wages lost due to injuries or illnesses that do not arise out of or in the course of employment (WCL §204). If you get injured or become disabled while you are eligible for or are collecting unemployment benefits, and if your injury or disablement results in you being ineligible for unemployment benefits, you are eligible for disability benefits.

Disability benefits are covered through your employer’s disability benefits insurance carrier or your employer may be self-insured. Coverage for disability benefits can be obtained through a disability benefits insurance carrier who is authorized by New York State Department of Financial Services to write such policies. Large employers may opt to become authorized by the Board to self-insure (WCL §211).

Paid Family Leave coverage is typically a rider on an employer’s disability benefits insurance policy.

New York introduced their Disability Benefits Law (DBL) program on January 1st, 1949. Their Paid Family Leave (PFL) program was implemented in 2018. Eligible Employees can take up to 26 weeks of combined paid leave for various family or personal health related reasons. Employers may meet their obligations under the State Plan, or can opt for a Private Plan.
